New Regulation for the endorsement of Individual Employment Contracts for national and foreign workers before the Ministry of Labor

The Ministry of Labor, Employment and Social Security, by means of Ministerial Resolution No. 001/2024 effective as from its official publication, that is to say, January 29, 2024, establishes:

  • New requirements for the endorsement of National and Foreign personnel contracts.
  • The term for the countersignature of a National employee’s contract is 60 days from the beginning of the labor relationship and subscription thereof and ratifies the term of 30 days for the countersignature of a Foreign employee’s contract.
  • It establishes the internal procedure for the endorsement by the Labor Authority.

 

a) National Worker Contract, it is divided into three stages for its review with a term of ten (10) working days computable from the entry, obtaining the endorsed Contract or observations that must be corrected within two (2) working days under the alternative of having the request rejected.

b) Foreign Worker Contract, is divided into 6 stages, concluding with the on-site verification at the place of work of compliance with the hiring regulations and establishes a term of five (5) business days computable from the issuance of the inspector’s report, whereby the employer obtains the endorsed Contract, rejection of the request or observations that must be corrected within two (2) business days.

Finally, it recalls that in the absence of a formal written contract, the contract is presumed to be for an indefinite period of time and does not provide for the possibility
